These Terms are a legally binding agreement between you and Madelyn Arsenault, doing business as Vysibl. By using Vysibl, you agree to these Terms. If you do not agree, you should stop using the app.
Vysibl is a shared calendar and task management app for iOS. You can create and share calendars, manage tasks, assign priorities, set recurring events, import calendars from your device, and organize your schedule with tags. Vysibl is not designed for regulated industries or use cases that require HIPAA, FISMA, GLBA, or similar compliance.
The Services are intended for users who are at least 18 years old. People under 18 are not permitted to register for or use Vysibl.
You may need to create an account to use Vysibl. You are responsible for keeping your login information secure and for all activity that happens under your account.
Some features may require a paid Pro subscription. Subscriptions, billing, renewals, cancellations, and payment processing are handled through Apple’s App Store. Subscription fees may change from time to time in accordance with applicable law.
All sales are final unless otherwise required by law or by Apple’s App Store policies.
We grant you a limited, revocable, non-exclusive, non-transferable license to install and use Vysibl on devices you own or control. You may not copy, modify, reverse engineer, resell, or misuse the app.
Vysibl, including its design, code, content, branding, features, and related materials, belongs to us or our licensors. These Terms do not give you ownership of our intellectual property.
You are responsible for the calendars, events, tasks, tags, notes, reminders, locations, and other information you add to Vysibl. You retain ownership of your content, but you allow us to use it as needed to operate, provide, sync, and improve the Services.
You agree not to misuse Vysibl. This includes:
If Vysibl allows you to submit feedback, comments, suggestions, or other content, you are responsible for what you provide. You agree not to submit anything unlawful, harmful, misleading, abusive, or infringing on someone else’s rights.
We reserve the right to monitor, manage, restrict, suspend, or remove access to the Services when needed to protect Vysibl, our users, our systems, or our legal rights.
Your use of Vysibl is also governed by our Privacy Policy. By using the Services, you agree to the way we collect, use, and protect information as described in that policy.
We respect intellectual property rights. If you believe something available through Vysibl infringes your copyright, please contact us using the contact information below.
These Terms remain in effect while you use Vysibl. We may suspend or terminate your account or access to the Services if you violate these Terms, misuse the app, or use the Services in a way that could cause harm.
We may update, change, suspend, or discontinue parts of Vysibl at any time. We try to keep the app available and reliable, but we do not guarantee that the Services will always be uninterrupted, secure, or error-free.
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles.
If a dispute arises, both parties agree to first try to resolve it informally for at least 30 days. If it cannot be resolved informally, disputes may be resolved through binding arbitration in Oklahoma County, Oklahoma, except where prohibited by law or where certain claims are excluded.
Vysibl is provided “as is” and “as available.” We do not guarantee that the app will meet every need, always be available, or be free of bugs, errors, or interruptions.
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability will be limited to the amount you paid us, if any, during the six months before the claim arose.
You agree to defend and hold us harmless from claims, losses, liabilities, damages, and expenses arising from your use of Vysibl, your content, your violation of these Terms, or your violation of another person’s rights.
By using Vysibl or contacting us electronically, you consent to receive communications from us electronically. Electronic notices, agreements, and records satisfy any legal requirement that communications be in writing.
California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs if a complaint is not resolved satisfactorily.
We may update these Terms from time to time. If we make changes, we will update the “Last updated” date. Continued use of Vysibl means you accept the updated Terms.
